Who determines how much of my security deposit the landlord retains?

When you move from the rental premises, the landlord has fifteen days from that date to return your security deposit if they’re not making a claim against it. If they are making a claim against it, they have to send you notice of that claim within thirty days via certified return receipt mail. Once you receive that letter with the claim, you then have fifteen days to respond and object to it. If you object to the amount and you can’t agree with the landlord, at that point, somebody would have to file an action in court, wherein a judge will make a decision as to how much of the security deposit the landlord is entitled to keep.
