Yes, in the state of Florida there is a rebuttable presumption that the rear vehicle is responsible for the accident in a rear-end collision. However, that presumption can be overcome in one of three ways. One, showing that the vehicle in the back had a mechanical failure. Two, testimony that the vehicle in front made a sudden or unexpected stop. Three, that the vehicle in front was illegally stopped in the road. If you’ve able to overcome that presumption at that point, the jury would make a determination as to the comparative fault of the parties.
