Yes, if you’re injured by the negligence of another person, you can recover damages for that negligence. Whether or not you’re a passenger in the vehicle isn’t pertinent. In fact, if you’re riding with somebody and they’re negligent, and you’re a passenger in their vehicle, you can recover damages against them for their negligence as well, as if there was a party … there’s a third party in another vehicle.
