In most instances, yes, you could sue the driver of a car in which you are a passenger if they’re negligent, and that negligence causes you to be injured. It would depend on if you were a named insured on their policy, for example a family member in your household. In that case you couldn’t, but if you were riding to lunch, for example, with a co-worker, and they ran a stop sign and caused an accident and you’re injured, you could bring an action against that driver.
