Does the landlord have to give me an opportunity to pay past due rent before evicting me?
Prior to filing an eviction action, the landlord is required in the state of Florida to serve what’s called a three day notice. A three day notice is either posted or delivered to the tenant and in that notice, it indicates the tenant owes the landlord rent and that they have three days, not including Saturday, Sunday, or legal holidays, to pay that rent. If they fail to do it within the time allotted, at that point, a landlord can file an eviction action.
