What happens if I am injured in Florida by an at-fault driver who doesn’t have auto insurance?

If you’re injured by a driver who’s not injured, you really have two avenues. The first one is you could sue that driver individually and try to collect from them, but generally speaking, if a person doesn’t have insurance, they’re not going to have assets, and you’re not going to have a collectible judgment. That’s why it’s important that you purchase uninsured/under-insured motorist coverage on your policy. That’s a coverage that you purchase that’s optional, and the purpose of that coverage is if you’re injured by somebody who either doesn’t have insurance or has insufficient insurance to compensate you for your injuries, then you would use your UM coverage on your policy.
